What are my rights when being arrested?

When you are being arrested, you have certain rights that are protected by law. These rights are commonly known as your Miranda Rights, which are based on the landmark 1966 Supreme Court case Miranda v. Arizona.

The Miranda Rights include:

The right to remain silent: You have the right to remain silent and not incriminate yourself. Anything you say can be used against you in court.

The right to an attorney: You have the right to an attorney. If you cannot afford an attorney, one will be appointed to you by the court.

The right to be informed of the charges: You have the right to know the charges against you.

The right to be informed of your rights: You have the right to be informed of your Miranda Rights.

It’s important to remember that you should exercise these rights during an arrest. You should remain calm and polite, but firm in asserting your rights. You should not provide any information or answer any questions until you have an attorney present.
